4D Diving and Adventures Constitution Revised June 2010 4D Diving & Adventures was founded in 2003. Our mission is to promote fun, safe environmentally responsible diving. We set a fun filled atmosphere where divers, their family and friends can be supported in their dive endeavors. Beginner divers can take advantage of those with more experience, while experienced divers can learn and fine tune their skills, lone divers can find buddies and most important of all we get our members to get out and dive in a safe structured environment.
The Constitution as posted on this Web site shall be considered the current and accurate version.
1. Name - 4D Diving & Adventures shall be known as the 4D Diving & Adventures.
2. Use of Name and Logo - All uses of the club name and logo must be approved by the club president prior to use.
3. Photos - Any photos taken of club activities and events will be deemed the club property and permissions given to use them for the benefit of the club must be approved by the club president prior to use.
4. Aims and Purposes - The aims and purposes of 4D Diving & Adventures shall be:
1. To Promote the sport of safe skin and recreational scuba diving
2. To conduct and assist in water anti-pollution measures when and where possible
3. To maintain high standards in all associated recreational scuba activities
4. To encourage interest in all activities associated with the underwater world, such as underwater photography, hydro-archaeology, underwater ecological studies and similar activities
5. To co-operate with other recreational scuba clubs and with Provincial and Canadian affiliates with similar objectives in strengthening and advancing the interests of the sport of recreational scuba diving.
6. Day to day operations of 4D Diving & Adventures shall be described by the "4D Diving & Adventures Constitution and Safety Protocol"
5. Jurisdiction
1. Diving Members - Certified recreational scuba divers with certification with a recognized certification agency shall be eligible for membership in the 4D Diving & Adventures. Although we actively promote ACUC these certifications include but are not limited to all R.S.T.C. recognized training agencies.
2. Non-diving members are also welcome for both snorkeling and non water activities.
6. Membership – Guests are invited to come out as our guest for up to two occasions, and then decide if they wish to join our fun filled club. A Waiver must be signed prior to participation. This will be available on the web site as well as from any of the club Dive Masters. Any person falling in the jurisdiction defined in point “4” can become a member of 4D Diving & Adventures by:
1. Signing and submitting to 4D Diving & Adventures a membership application form and waiver form as prescribed by 4D Diving & Adventures
2. As well as paying any initiation and membership fee prescribed by 4D Diving & Adventures.
3. By agreeing to uphold 4D Diving & Adventures Constitution and Safety Protocol as published on 4D Diving & Adventures Web site.
4. Types of membership of 4D Diving & Adventures shall consist of:
1. Regular Members must be certified recreational scuba divers as defined in Article 4.
2. Long Distance Members
3. Life Members shall be any regular members of 4D Diving & Adventures who has served 4D Diving & Adventures for a minimum of twenty consecutive years. S/he must be nominated by a member of 4D Diving & Adventures and approved by a simple majority vote at a general membership meeting.
4. Honorary Members shall be members in good standing and be recognized for their contributions to recreational scuba diving.
5. Non-Diving Members shall be any persons interested in any of 4D Diving & Adventures activities who cannot join as a regular member because of his non-diver status.
5. All of these members shall agree to be governed by the constitution and by the Safety Protocols 4D Diving & Adventures.
6. A Member shall remain in good standing provided s/he is:
1. Not more than three months in arrears in payment of dues.
2. Not penalized by suspension or expulsion from 4D Diving & Adventures.
3. A person who ceases to be a Member by reason only of non-payment of dues shall be reinstated upon submission to 4D Diving & Adventures of a new membership application accompanied by all arrears in dues.
7. Membership Rights - Every Member in good standing is entitled:
1. To be treated with dignity and respect
2. To be free from discrimination, interference, restriction, coercion, harassment, intimidation or disciplinary action exercised or practiced by a Member with respect to another Member by reason of race, colour, age, national or ethnic origin, orientation, political or religious affiliation or physical or mental disability
3. Proper conduct and language: At all times all club members and their guests must behave and speak in an appropriate manner, which reflects the nature of the fun family atmosphere. Profane or abusive language is prohibited. In addition, we must remember that we are all representatives of our club and want it to be seen with respect in the community.
4. To receive a copy of the Constitution of 4D Diving & Adventures. The current and up to date copy of the Constitution and Safety Protocol which is posted on 4D Diving & Adventures Web site.
8. Termination of Membershipin 4D Diving & Adventures
1. May be voluntarily withdrawn by disbandment
2. By any action, which in the opinion of a two-thirds majority of the staff is contrary to the aims and purposes of 4D Diving & Adventures.
3. If the member fails to follow 4D Diving & Adventures safety protocol as currently published on the Web Site.
4. Following a full review of the reasons and circumstances and by a two-thirds majority vote of the Staff a suspended or expelled Member may be reinstated provided that agreement is also made by a two-thirds majority vote of the members present at a general membership meeting.
11. Executive Members and any chairperson(s) shall be appointed by the existing staff as detailed on this web site. An executive member, staff member or chairperson for any committee may be removed from the position only by a properly convened meeting of the staff of 4D Diving & Adventures.
12. Executive - The Members of the Executive shall be the Executive Officer / President and Treasurer. Advice and guidance shall be received from the Chief Instructor, Chief Dive Master and the Dive Master Staff. The executive staff shall be the governing body of 4D Diving & Adventures. Its primary responsibilities are to take the necessary action and decisions to:
1. Uphold and enforce the provisions of this Constitution and safety protocol
2. Implement the decisions where possible of the membership
3. Formulate and implement policy
4. If, because of changing circumstances or to meet essential operational requirements, the executive deems it necessary to make a decision contrary to a decision of the Members, such decision shall only be done after a 30 day notice period allowing members to voice their opinions.
5. The Treasurer and members of the Executive, by virtue of their offices, shall collectively hold title to all monies, records, and property of 4D Diving & Adventures.
6. The Executive shall have the sole authority to approve any proposed investments or borrowings.
7. The Treasurer, in consultation with the rest of the executive shall cause to be prepared an annual budget for 4D Diving & Adventures.
8. The Executive shall establish policies on financial administration to ensure that all monies of 4D Diving & Adventures are handled, used, and accounted for in accordance with prevailing standards of good business practice.
9. The Executive may appoint or elect such standing Committees from among its Members as it may deem necessary to assist in the supervision of the affairs of 4D Diving & Adventures. It may also appoint ad hoc Committees for specific periods of time. All ad hoc Committees shall report to the Executive.
13. Revenue and Expenses
1. The due structure will be posted on the club web site.
2. The level of regular Club dues shall be as prescribed by the Executive, but no increase may take effect until without cause or reason. Notice of the increase along with reasons shall be sent to all Members at least three months notice of the Annual dues assessment.
3. All money for all club initiatives shall be sent or given to the Treasurer with no exception.
4. The fiscal Year of 4D Diving & Adventures shall be January 1 to December 31.
